Předkládaná studie se zabývá vztahem mezi reformním hnutím v západní církvi ve středověku, které obvykle označujeme jako gregoriánskou reformu, a formativními fázemi vývoje kanonické jurisprudence z perspektivy moderní historiografie. Východiskem je teze Paula Fourniera, již předložil v článku Un tournant de l'histoire du droit (1060-1140) publikovaném v roce 1917, a která reprezentuje nikoli pouze první vážný pokus zodpovědět tuto otázku ale zároveň etablování tematického pole pro další bádání. První polovina studie rekapituluje Fournierovu argumentaci, její vliv na historiografii a prameny, kterými je podložena. Druhá polovina se zabývá pozdější kritikou Fournierovy koncepce, která započala v sedmdesátých letech 20. století, a reinterpretací pramenů z této perspektivy.
The present paper is concerned with a relation between reforming movement within the western church, usually referred to as the Gregorian reform, and formative stages of the development of the canonical jurisprudence from the perspective of modern historiography. The point of departure is Paul Fourniers' thesis presented in his article Un tournant de l'histoire du droit (1060-1140), published in 1917, which represents not only the first serious attempt to answer the question, but also the establishment of the field of interest for the further research. The first half of this essay reiterates Fourniers' argumentation, its influence on historiography, and sources engaged in its support. The second half focuses on later criticism of Fourniers' thesis inaugurated in 1970's, and from this perspective resumes discussion of the sources.
