Príspevok zachytáva manželstvo v spleti zákonov, záujmov štátu a Katolíckej cirkvi. Predostretý postoj spoločnosti k manželstvu sme priblížili na základe legislatívnych úprav Československého štátu v oblasti manželského práva. Manželskoprávny vývoj je analyzovaný so zreteľom na obdobie prvej Československej republiky resp. na "manželskú novelu". Štúdia odkrýva návrhy, priebeh, problémy, nedostatky, ktoré vznikli s jej zavádzaním a realizáciou, ako aj so snahou odstrániť vzniknuté problémy. Predchádzajúce úpravy a zmeny v oblasti manželského práva od čias Jozefa II. sme stručne analyzovali s cieľom vytvoriť kontinuálny prechod k "manželskej novele". V poslednej časti sa štúdia venuje participácii Katolíckej cirkvi na manželskoprávnych úpravách.
This contribution shows a marriage in the tangle of law, state's interests and the Catholic Church. The presented attitude of the society towards a marriage has been outlined on the basis of legislative amendments of the Czechoslovak state in the area of the marriage law. The development of the marriage law is analysed with respect to the period the first Czechoslovak Republic, resp. "the marriage amendment". The study reveals bills, the course, difficulties and imperfections, which arouse with its application and realization as well as with the effort to eliminate newly-emerged problems. The previous adjustments and changes in the area of the marriage law from the times of Joseph II have been briefly examined with the goal to make a continual transition to "the marriage amendment". The final part of this article occupies itself with the participation of the Catholic Church in the legislative amendments of the marriage law.
